Legal Postings – Addington II

Available now and in the Legal Library is USAPA’s Reply in Further Support (Doc 229) to USAPA’s earlier filed Motion to Continue (Postpone) the hearing in this case. Also available is an Order (Doc 230) issued today from the Court that reads in its entirety:

Defendant US Airline Pilots Association (“USAPA”) has asked to reschedule the trial set to begin on October 22, 2013. In light of this case’s history, the Court needs to speak with one of Gary Hummel’s doctors. USAPA will be directed to contact the doctor and see when he or she is available to participate in a conference call with the Court. The conference call must occur on either October 17 or 18. Counsel will be required to either appear in person or by phone. The trial will not be continued until the Court is able to speak with a doctor.

Accordingly,

IT IS ORDERED as soon as possible Defendant US Airline Pilots Association shall file a notice indicating when one of Gary Hummel’s doctors is available for a conference call. All counsel must make every effort to be available at the time chosen by the doctor.

Legal Postings - Addington II

The following papers were filed yesterday, October 16, by USAPA in Opposition to the four Motions In Limine filed on October 11, by the Plaintiffs. Motions In Limine are requests that the Court exclude certain testimony and evidence from trial. Also filed yesterday was American's Reply to the Motion to Participate as Amicus Curiae. Legal Postings - Addington II

Yesterday USAPA filed a Motion for Continuance (Doc 221), requesting to postpone the Addington II Hearing set for October 22-23, because of the unavailability of President Hummel to either testify or assist at the trial. 

Plaintiffs filed an opposition (Doc 222).  The parties participated in a telephone conference with Judge Silver’s clerk yesterday afternoon.  US Airways said it would file an opposition later today (Wednesday, October 16), and USAPA will file a reply not later than tomorrow (October 17).

Legal Postings - Addington II

The following October 9, 2013, Addington II filings are now in the Legal Library:

These are all “joint” documents which, although filed by the Plaintiffs, include several jointly agreed upon sections and many sections that include separate statements by each of the parties.  As an Intervenor, US Airways fully participated in preparing the documents, although there is little in the way of separate statements of sections from US Airways.

Legal Postings – AMR DOJ Action

The following October 1, 2013 AMR DOJ Action filings are now in the Legal Library:

Yesterday, October 1, Judge Colleen Kollar-Kotelly issued an order denying the DOJ’s request to stay the case. Soon after, Texas Attorney General filed a Notice of Settlement, stating in its entirety:

“The State of Texas wishes to notify the Court that it has entered into a settlement agreement with US Airways Group, Inc. and AMR Corporation. The agreement resolves the claims of the State of Texas, but it does not purport to address the claims of the other plaintiff states or the Department of Justice. The State of Texas is in the process of meeting and conferring with all parties to the litigation to notify them of the settlement. Once we can assure the court that no party opposes our position, the State of Texas will file its Motion to Voluntarily Dismiss its Claims with Prejudice.”

In addition, a Minute Order (paperless) of October 1, 2013 Court Conference (a summary of the results of the conference by the court) states:

The Court held a Status Conference in this matter at 10:30 AM on October 1, 2013, at which the parties mutually agreed on the following matters. At the request of the parties, the Court expands the scope of the referral to the Special Master to include the treatment of information designated as "confidential", including whether such information should be filed under seal. Furthermore, by no later than OCTOBER 15, 2013, the parties shall provide the Court with a Joint Trial Procedures Order governing trial-related dates and procedures. The Court provided the parties with a list of dates by which certain materials should be submitted to the Court, but left to the parties whether to set earlier dates if more convenient. A Status Hearing in this matter will be held on OCTOBER 30, 2013 at 4:00 PM. By no later than 5:00 PM on OCTOBER 28, 2013, the parties shall file a Joint Status Report alerting the Court as to any issues that require the Court's attention at this Status Hearing. Finally, a Pre-Trial Conference in this matter will be held on NOVEMBER 21, 2013 at 10:30 AM.
