Litigation Status Report

On November 20, 2008, Judge Neil V. Wake of United States District Court for the District of Arizona issued an order in Addington v. USAPA/US Airways litigation; the order is posted in the Litigation Library of the USAPA web site.  Judge Wake dismissed Counts One and Two of the Plaintiffs' Complaint and denied the Plaintiffs' Motion for a Preliminary Injunction.  He declined, however, to dismiss Count Three of the Complaint and stated the court's desire to move forward with a trial on that count within three months or less.

Litigation Status Report

Counts One and Two

Counts One and Two related to the Plaintiffs effort to enjoin the furlough of pre-merger West pilots.  Count One seeks an order compelling the furlough of all New Hire East pilots prior to the furloughing of any pre-merger West pilots.  USAPA has filed a grievance that seeks similar relief.

Count Two seeks an order compelling US Airways not to furlough any West Pilot before it has furloughed all East pilots junior to them on the Nicolau List.  Former ALPA MEC Chairman John McIlvenna filed a grievance, now pending before the Transition Agreement System Board, seeking the same relief.
