BPR Special Telephonic Meeting Recap

In accordance with the USAPA Constitution & Bylaws and USAPA Operating Manual, President Bradford called a Special Telephonic meeting of the Board of Pilot Representatives to commence at 4:00 p.m. ET on Monday, January 25, 2016 for the purpose of authorizing mediated settlement negotiations currently planned for January 26, 27 and 28. 


On the call were President Steve Bradford, Secretary-Treasurer John Owens, Communications, and the following BPR Members:


CLT: Lew Milliner, Ed Royko (DDR for second seat)
DCA: Steve Nathan (present via Go-Go)
PHL: Jerry Redden (DDR for John Taylor), Courtney Borman (DDR for Mike Gillies), and Walter Hall

At approximately 4:08 p.m. ET, President Steve Bradford called the meeting to order.

The following resolution to authorize mediated settlement negotiations was moved/seconded by Milliner/Royko:


Whereas: Magistrate Judge David Keesler, of the United States District Court for the Western District of North Carolina, Charlotte Division, has ordered mediation between the parties to the consolidated North Carolina actions, including the USAPA Declaratory Judgment action and the Bollmeier actions, including all counterclaims, cross-claims, and third parties actions; and


Whereas: USAPA believes it is in the best interest of this association and its membership to participate in this mediation to seek a permanent global settlement of any and all litigation and potential litigation involving USAPA; and 


Whereas: The mediation is scheduled to begin in Charlotte on Tuesday, January 26th; and


Therefore be it resolved: The USAPA Officers and Board of Pilot Representatives authorizes, together with Individual Defendant Counsel, USAPA General Counsel and the USAPA Officers, to engage in mediation on behalf of USAPA, to seek and secure a global resolution of all pending claims affecting or potentially affecting USAPA; and


Be it further resolved: That at the end of action and discussion on this resolution, the USAPA Board of Pilot Representatives meeting will recess to the “call of the chair”. Upon resumption of the meeting there will be review and action on any potential settlement.


Brief discussion followed and, at 4:30 p.m., the Motion passed unanimously. The negotiations started today, January 26, at 9 a.m.


With no other business to discuss, a motion to recess to the call of the chair was moved/seconded by Borman/Royko, and passed unanimously. (Note: Royko held Proxy for Lew Milliner at the time of this vote.)
